Soil Erosion and Sediment Control Plan Requirements

 

Requirements for one (1) or more acres of land disturbance in Henderson County Unincorporated Areas, Town of Laurel Park, Village of Flat Rock, Town of Fletcher and City of Hendersonville.

Refer to the links on the left side of this webpage for more information regarding "Fee Schedule", and "NPDES and Self-Inspection requirements". If the proposed development has any Local, State, or Federal Funds associated, the authority having jurisdiction is the Asheville Regional Office of the Department of Environmental Quality.  They can be reached at (828) 296-4500.

PROCEDURES:

Permit request must be made using the online portal: (SmartGov)

Submittals shall include:

Electronic files (PDF Format) of the following:

  • Application (Financial Responsible Owner Form)(Original Signature)
  • Plan sealed by a North Carolina design professional
    • Self-Inspection and NPDES:
      • Two Sheets need to be added to the SESC plan for NPDES compliance. (See link to left)
  • design calculations signed and sealed by a North Carolina design professional
  • Designer Checklist
  • Narrative
  • Any other local, federal, or state permit approval required from the authority having jurisdiction. (i.e. Driveway permit, encroachment agreements, 401/404 permits, etc)

*Original Signature notarized paperwork hard copies must be mailed to our office.

Note:  The project submittal shall not be accepted in SmartGov for review until all items are submitted.

General Information: (common elements absent from erosion submittals)

  • Not providing all erosion control design elements utilized on the design with details, construction and maintenance notes on the Plan.
  • Not providing a legend of symbols used must be provided on Plan.
  • Not providing a vicinity map shall be included on Plan.
  • Not providing a North Area shall be included on Plan.
  • Not providing a (standard) scale must be provided on Plan.
  • Not providing notes sequencing the construction process on plan sheet.
  • Not providing sequence of transitioning the two proposed sediment basins to the two proposed stormwater control measures. (If applicable)
  • Not providing the following notes under erosion control notes:
    • "A pre-construction meeting is required prior to any land disturbing activity beginning.  Contact Henderson County Soil Erosion at (828) 694-6521.”
    • “No person may initiate a land-disturbing activity before notifying the agency (Henderson County Soil Erosion at phone number (828) 694-6521) that issued the Erosion and Sedimentation Control Plan approval of the date that land-disturbing activity will begin.”
    • “Whenever the Soil Erosion and Sedimentation Control Administrator determines that significant erosion and sedimentation is occurring as a result of land-disturbing activity, despite application and maintenance of protective practices, the person conducting the land-disturbing activity will be required to and shall take additional protective action."
  • Not providing information regarding Borrow and Waste Areas (42-259.D) – Borrow and Waste Areas are required to be active permitted sites. (Applicable If site cut and fill does not balance)
  • Not providing detailed soil erosion and sedimentation control measures (clearing/grubbing, transitions, final grade, etc) on separate plan for clarity.
  • Not providing owner’s written consent (DOT or adjacent property owners) for land disturbing activity within the NC DOT designated right of way or adjacent property.
  • Not providing an approved driveway permit from NC DOT or other authority having jurisdiction prior to any land-disturbance proposed in NC DOT right of way.
  • Not providing dimensions of baffle spacing in plan views.
  • Not providing design calculations for peak discharges of runoff (including the construction phase & the final runoff coefficients of the site)
  • Not providing Profiles and Elevation of all proposed roadway.
  • Not providing design calculation for culverts and storm sewer channels and ditch flows.
  • Not providing other federal, state or local permits required. (example: 401 and/or 404 permit for wetland and stream crossings)
  • Not providing a Flood Damage Prevention approved permit from jurisdiction having authority for work in a designated FEMA floodplain.

Review Time

Complete submittals (drawings, calculations, forms and fees) will be reviewed on a first in first out basis.

Review time for new submittals - 30 working days. (we strive to complete in 15 working days)

Review time for re-submittals - 15 working days. (we strive to complete in 7 working days)
